TRURO — A judge has recommended that James Pumphrey, who is accused of trying to kill his two-month-old son, be transferred to protective custody or a different correctional facility.

Pumphrey has faced death threats and had garbage and excrement thrown at him in jail in Dartmouth since being arrested last week on attempted murder and aggravated assault charges involving his young son, said Mahoney.

Pumphrey, 23, of Hilden, made a brief appearance in Truro provincial court Monday morning where his lawyer, David Mahoney, asked the judge to recommend the change.

The baby was taken to Truro hospital on March 22 and then sent to the IWK Health Centre in Halifax with severe brain damage and broken ribs.

Outside the courthouse, Ralph Gosby carried a sign with the word "shame" written on it. Gosby said he was there to speak out about violence against children and that, as a father, he was troubled by the situation.

"This is making me sick," he said.
