A few weeks before Pablo Josue Amador shot and killed his wife and two daughters before taking his own life, 14-year-old Priscila Amador told two classmates her father had molested her since she was in elementary school.

One student advised her mother of the allegation and then told reporters about it outside the Amador home in Perrine on Wednesday, hours after the killings. The other classmate alerted her father, who told The Miami Herald on Thursday that Priscila had given a ''desperate'' letter to his daughter before her death.

The father, who said he was ''shocked'' when he read the letter, asked not to be named to protect his daughter's identity. He said police came to his house after the killings and took the letter.

Police say Amador, 54, shot and killed his wife, Maria Joy, 47, and daughters, Rosa, 13, and Priscila, shortly before 6 a.m. Wednesday inside their Palmetto Country Club Estates home. Son Javier called 911 and fled, unharmed. Bea, the eldest child, was not home.

The deaths rattled neighbors and classmates at Southwood Middle School, where a 2004 murder shocked students and staff. Eighth-grader Jaime Gough was stabbed to death in a bathroom of the Palmetto Bay magnet school by his friend Michael Hernandez, then 14.

Thursday, students brought flowers, teddy bears and cards for a makeshift memorial on the Amadors' lawn as the abuse allegations began to surface.

Marcela Cojulun, 14, a close friend and classmate at Southwood, said Wednesday that Priscila had recently told her that her dad had molested her for years, since she was between 6 and 8 years old.

''She was telling me . . . throughout her life her dad would sexually abuse her. She was done with it and she didn't want to live,'' Marcela said.

Marcela said she told her mother what Priscila had said about the molestation. Marcela's mother, Gloria Cano, told reporters Marcela advised her of the allegations about a month ago and that she wishes now she had acted.

''I really regret it,'' Cano said.

``I don't know if I was the only adult. I don't know if this would have stopped. I don't have words.''

It's unclear if Priscila had told anyone else about the allegations, Marcela said.

UPSET AT SCHOOL

The father of the second classmate said his daughter told him about the allegations about two weeks ago, and that Priscila had been upset in school.

''When I read the letter she wrote she was a desperate person,'' the father said.

Marcela said Priscila had been ''emotionless'' the past few days at school and asked her friend ''to pray for her.'' Marcela said she encouraged Priscila to speak with someone about the abuse.

''I tried to be as positive as I could with her,'' Marcela said. ``I told her I loved her and to stay strong. I said she had to talk to somebody about this. She said she was too chicken to talk to her mom about it.''

She also said that Priscila had become so despondent that she had recently cut herself in two places.

''She couldn't take any more, being sexually abused,'' Marcela said.

Priscila recently wrote a post on MySpace.com that suggested she was experiencing personal problems but did not mention molestation.

''I have gone through so much and yet I still try to stand tall, because this whole world is coming down on me, and me blocking it hurts more and more,'' she wrote. ``That's why I don't care anymore.''

Miami-Dade police would not talk about the abuse allegation Thursday, but they said they are looking at all possible motives.

''We will follow up on [the molestation claim] like any other possible lead until we are able to come to the conclusion as to what caused this individual to commit such violent acts,'' said Detective Alvaro Zabaleta, a Miami-Dade police spokesman.

Officials from the state Department of Children and Families said records show the agency had no prior contact with the family.

The Rev. Brian Carr, pastor at Perrine-Peters United Methodist Church, where the family attended weekly services, said he was unaware of any molestation allegations.

''I had no inkling that anything was wrong. I don't want to get into it. I know nothing about any of this,'' he said.

The surviving Amador children -- Javier, 16, and Bea, 20, a University of Miami student -- were unable to be reached for comment.

SCHOOL'S DEJA VU

The Hernandez incident five years ago lingered in the minds of Southwood's teachers and administrators as they processed the news of Wednesday's killings.

''Even though this didn't happen at the school, this was an extension of who we were,'' said Justin Koren, one of Javier Amador's language arts teachers. ``Once that happened, we're no longer teaching English. We were teaching life.''

Koren joined the school a year after Jamie's murder and eventually wrote a play inspired by the incident about how a school copes with shattering tragedy.

Priscila's and Rosa's friends were dismissed from class Wednesday to deal with their grief. Crisis counselors have been deployed to the school and are expected to be there Friday as well.

''The day after is almost worse,'' Koren said. ``You have shock on day one and the reality sets in on day two. We just have to be here together.''

    When I first heard this story, I assumed the family might have suffered a tremendous financial setback due to the economic situation. But learning of alleged molestation of the daughter by the father, makes this case more heartwrenching. This is what I have to say to 'any child being abused' by your parents or anyone:
    When you're home alone, especially at night and it's dark in your room, get down by your bed and say a prayer; and God will keep you in His care. When the door squeaks open and a strange dark shadow's on the corridor wall, hurry flick on the light and stand tall. Though you may feel nervous and scared, scream as loud as you can, to ward off the evil and treacherous man. If the callous person still advances and violate your space, just stare them in the face, and let them know, to the police you will go!!!!!
    God please protect our children. Give them the courage to report abuse to a teacher, adult relative, and police.

    Ultimately, the father is responsible for this tragedy. He made the choice to murder his family. However, those people who had any inkling that something horrible was happening to those children had a responsibility to make it known to authorities if not the school district. Maybe this could've been prevented.

    Both parents that knew made poor judgement by not reporting it immediately. This is a wakeup call, always get involved when children are in trouble. But dont blame them, it was the father who did this. They are only at fault for poor judgement and have to live with this. My prayers are with these two parents to forgive yourself. And to teach us to always speak out even if it turns out not true. And to the two surviving siblings. There is alot of people praying for you. God bless us all.

    Jezebel, with all due respect, your grabbin at straws. I think you are confused regarding the meaning of hearsay. This is not about hearsay. The mother of one of th girls went on record with the reporter and said her daughter told her. The mother did not report the comments to the proper authorities. It was not for her to decide if the comments were true or false, she had to tell the authorities, so they could make that call. The father of the other child said there was a letter. The article reports that the police took the letter. It is up to the police to invesitgate the authenticity of the letter. The point of the article is not whether she was abused or not. The point is that two parents admitted on the record that they had prior knowledge and that neither parent did anything to report it. The two parents made comments directly to the reporter. Those comments did not pass through the grapevine. I'm sorry but you are wrong. Now the police will do their jobs.

    If this man had nothing to hide why would he kill very body . I'm sure the girl told her mother and her mother confronted the father maybe she told him she will take the girl to the doctor to see if it was true and if it was she will put him in jail and he got scare of the truth coming out and the shame that his mask will come off and killed everybody cause he was selfish by doing this to his daughter and he was selfish to be discover and go to jail so he took everybody life for them not to talk . But he did not know his Pricilla had given a letter to a friend and talked about it with friends and the truth came out anyway .

    Since when is hearsay not hearsay? The reporter sais, Mrs. Cano words were that her daughter told her that the friend said... If that is not hearsay, then what is!
    Until the police investigators find some proof --or at least say that there is some indication to the possibility-- but not even that... there has been nothing except reporters saying that this lady or the other said their daughters said that their schoolfriend victim told them... And then there's the famous letter, which the police took; do you know what the letter sais?
    Have some faith, people!

    Jezebel the fact is that Mrs. Cano says her daughter told her a month ago, and now she really regrets it. Those are Mrs. Cano's words to the reporter, not hearsay, or rumor. The woman was quoted. I agere, you cannot believe everything the press tells you. But this is a direct quote from the parent. Mrs. Cano might think about finding an attorney. So your point about the media does not apply in this instance.

    KatyMay you say that "often these allegations are made to lash out at a parent as a dramatic appeal for attention" and "stop blaming the parents who failed to report". If you know anything about the laws that were made to protect children from abuse, you would know that first and formost is the safety of the child. In the eyes of the law, the childs rights take precedent over all else. Either way you cut it, if she was abused or if she was lying, the child needs help. These two parents failed her and their own children who confided in them miserably, and for that there is no excuse.

March 8th - “Jana Mackey Day in Kansas”


Hays, KS – In the coming days Kansas lawmakers will be joining Governor Kathleen Sebelius in recognizing International Women’s Day on March 8th by honoring a recent victim and fatality of domestic violence.


Jana Mackey, a 25 year old KU law student was murdered by her ex-boyfriend last July in Lawrence. Jana was well known throughout Kansas for her work on many women’s issues.
Governor Sebelius has signed a proclamation recognizing March 8th as a “Jana Mackey Day in Kansas.”


On March 5th Senator Janis Lee (D-Kensington) and Senator Marci Francisco (D-Lawrence) will be sponsoring a resolution honoring Mackey. On the House side, Representative Eber Phelps (D-Hays), Representative Barbara Ballard (D-Lawrence), and Representative Paul Davis (D-Lawrence) will be presenting Mackey’s family with a formal certificate on March 9th.


Mackey, who grew up in Hays, had spent endless hours volunteering to aid victims of sexual assault and domestic violence. She had also served three years as one of the youngest lobbyists at the Kansas Capitol with the National Organization for Women.
After her death, Mackey’s family and friends established a national campaign to help her service live on through others. Symbolic of the number of people who attended her funeral, the Eleven Hundred Torches campaign urges hundreds of ordinary citizens to serve others.


Governor Sebelius has joined the campaign and is calling on all Kansans to set aside time on March 8th to volunteer in their communities.
Special volunteer events are being planned in Hays and in Lawrence on that day.
International Women’s Day began in 1908 with a 15,000 women’s march through New York City calling for equal voting and work rights for women. In 1913 the event was officially scheduled as March 8th. Today International Women’s Day is celebrated world-wide and is an official holiday in 15 nations.

GHENT, Ky. -- Authorities discovered a 37-year-old Kentucky man and his 2½-year-old son dead inside a Ghent residence on Friday, saying evidence points to a murder-suicide.

State troopers were called to a domestic violence complaint shortly before 9:40 p.m. in the 300 block of Campbell Road in Ghent.

Ralph Michael Utley, 37, and his toddler son were found not responsive, and the Gallatin County coroner pronounced both dead shortly after 10:30 p.m.

Autopsies were scheduled.

Ghent is located a little more than 55 miles between Cincinnati and Louisville.

Study confirms effects of early environment in brains of suicide victims

McGill University and Douglas Institute scientists have discovered that childhood trauma can actually alter your DNA and shape the way your genes work. This confirms in humans earlier findings in rats, that maternal care plays a significant role in influencing the genes that control our stress response.

Using a sample of 36 brains; 12 suicide victims who were abused; 12 suicide victims who were not abused and 12 controls, the researchers discovered different epigenetic markings in the brains of the abused group. These markings influence the hypothalamic-pituitary-adrenal (HPA) function, a stress-response which increases the risk of suicide.

This research builds upon findings published last May that showed how child abuse can leave epigenetic marks on DNA.

But, in this, the first study of its kind, Moshe Szyf, a professor in the Department of Pharmacology and Therapeutics; Gustavo Turecki, associate professor in the Department of Psychiatry who practices at the Douglas Mental Health University Institute; Michael Meaney, a professor in the Departments of Psychiatry and Neurology and Neurosurgery, who is also at the Douglas; and McGill postdoctoral research fellow Patrick McGowan have built on their world-renowned epigenetics work to uncover how parental care affects the DNA in the brains of a group of Quebec male suicide victims who suffered abuse as children. The all-McGill study is set to be published in the February 22, issue of the journal Nature Neuroscience.

“We know from clinical experience that a difficult childhood can have an impact on the course of a person’s life”, said Dr. Turecki.

“Now we are starting to understand the biological implications of such psychological abuse,” added Dr. Szyf.

“The function of our DNA is not as fixed as previously believed, said Dr. Meaney. “The interaction between the environment and the DNA plays a crucial role in determining our resistance to stress thus the risk for suicide. Epigenetic marks are the product of this interaction.”

Epigenetics is the study of changes in the function of genes that don’t involve changes in the sequences of DNA. The DNA is inherited from our parents; it remains fixed throughout life and is identical in every part of the body. During gestation and even later in development, however, the genes in our DNA are marked by a chemical coating called DNA methylation. These marks are somewhat sensitive to one’s environment, especially early in life. The epigenetic marks punctuate the DNA and program it to express the right genes at the appropriate time and place.

The researchers discovered that maternal care influences hypothalamic-pituitary-adrenal (HPA) function in the rat through epigenetic programming of certain receptors in the brain. In humans, child abuse alters HPA stress responses and increases the risk for suicide.

In previous studies in laboratory rats, the group proved that simple maternal behaviour such as mothers who licked their pups during early childhood has a profound effect on the epigenetic marks on specific genes and effects on behaviour in ways that are sustained throughout life. However, these effects on gene expression and stress responses can also be reversed in adult life through treatments known to affect the epigenetic mark known as DNA methylation.

The brain samples in the latest study came from the Quebec Suicide Brain Bank, administered by Dr. Turecki of the Douglas Mental Health University Institute. With the support of the Bureau du Coroner du Québec (Office of the Chief Medical Examiner), the McGill Group for Suicide Studies (MGSS) founded the Quebec Suicide Brain Bank (QSBB) at the Douglas Mental Health University Institute, to promote studies on the phenomenon of suicide. Research carried out on brain tissue can help develop intervention and prevention programs to help people suffering mental distress and who are at risk of committing suicide.

The research was funded by the Canadian Institutes for Health Research and the National Institute of Child Health and Development (USA).

Only days after walking down the red carpet in Hollywood the ten-year-old film star was slapped and kicked by dad, Ismail, after refusing to be put on display like a trophy.

One onlooker said: “It was like a scene out of Slumdog Millionaire.”   The lad’s dad has since apologised for striking his son.   “I was very sorry that I did what I did,” said the repentant father.   “I was so confused and stressed by my son’s homecoming that I did not know myself for a minute. I love my boy and I am very happy to have him home.”

The ugly scenes, which lasted no more than 30 seconds, broke out at around midday today Indian time in the Dharavi slum in Bandra, Mumbai.

Azharuddin, who had been given a day off school, was tired after his long haul flight from LA and prolonged hero’s welcome amid a media scrum yesterday.  And when he refused to be put on display outside his home this afternoon, his father lashed out, kicking and slapping him round the face.

Punishment

His mother cried out for him to stop, but Ismail continued to dish out the physical punishment to the child-star.  Azharuddin stood up to his dad, flaring the temper of the 45-year-old, who launched himself at the lad shamelessly.  Azharuddin yelped out as he tried to evade the older man’s flailing hands and feet.

He dashed into the tent that makes up his family home, followed by his father, where the young Slumdog star tried to cower in the corner.  Azharuddin grabbed his face in pain and then ran off to cry.

“Azharruddin’s father was upset that he was asking to be left alone because he was tired,” said one shocked onlooker.   “He didn’t attend school today so that he could recover from his long flight from LA and simply wanted all the attention to stop.   “However, when Azharuddin put his foot down and said that was it and there was to be no more talking, Ismail just flipped.

“It was like a scene out of Slumdog Millionaire.”

Talking only moments before his father’s attack, Azharuddin spoke of his tiredness due to the long flight.   “I do not want to speak today to any reporters,” he said.

Someone told me I was on this website. I am not exactly sure of your purpose. But I would like to make it clear to everyone that this case does not involve a “battered mom”. My mistake was taking at face value a petition filed by the father in his own paternity action asking for temporary custody of his child. I knew nothing of the police involvement prior to the petition being filed. I erred by not requiring more information at the time I received the request for temporary custody. I made a mistake and acknowleged my error. However, I do take offense to any article or blog that refers to me as being “corrupt”. I am not a dishonest judge. I am a hard-working family man who has done many fine things for the county and state for which I serve. I do not expect anyone to feel sorry for me, I just want to set the record straight. Thank you.

The Indiana Judicial Qualifications Commission is Tired of Erring Family Court Judges and Lawyers

The Indiana Judicial Qualifications Commission is Tired of Corrupt Erring Family Court Judges and Lawyers

Recently punished Judge Daniel C. Banina, Miami Superior Court 2, and Lawyer Jeffry Price, of Peru, Indiana, has brought a warning from the Commission to all family court judges and lawyers:

In the Commission’s view, there is perhaps no greater injustice than to strip a parent of custodial rights without an opportunity to be heard and in the absence of an emergency. The Commission calls upon all judges and lawyers in Indiana to respect this fundamental notion, on the Commission and its counter-part, the Supreme Court Disciplinary Commission, attempted to convey now for several years, only to repeated address the same violation.

A local judge and attorney are being publicly reprimanded for violating the state’s professional and judicial conduct rules. The Indiana Commission on Judicial Qualifications has issued a public admonition against Judge Dan Banina and the Indiana Supreme Court Disciplinary Commission has imposed a public reprimand against Attorney Jeffry Price, both stemming from a February 2007 incident concerning the custody of a child. According to a press release, the commission states the incident involves a mother and father who were divorced but living together.

The couple had a child, but that child was under the sole custody of the mother. In January 2007, the mother decided to move from their home and take the child with her. The father and local police intervened and demanded she leave the child with the father. Then Price, the father’s attorney, filed a petition to establish paternity which included an emergency order for his client to receive temporary custody of the child. Banina granted it the next day, February 2, 2007. The order was granted in favor of the father without prior notice given to the mother - the only notice she received was service of the petition about two weeks after it was filed.

According to the commission, Banina should have ensured the mother had notice of the petition and held a hearing to resolve the custody dispute. Likewise Price, in seeking and obtaining the order, deprived the mother of an opportunity to be heard before the order was granted. Banina says he “made a mistake.” “I thought I was doing the right thing at the time,” he explained. “I should have required more information.”

Although charges were warranted, Banina’s admonition states, the judge is not being formally charged with misconduct. He cooperated fully with the commission and acknowledges he violated the Code of Judicial Conduct. His only punishment is to be publicly warned concerning the matter, which is the purpose of the admonition.

The decision of whether or not to file charges is generally based on prior history of disciplinary action or lack thereof, severity of the misconduct and whether or not the code was willfully violated, among other things. That’s according to Kathryn Dolan, the Indiana Supreme Court’s Public Information Officer.

Dolan said this is the first disciplinary action to be taken again Banina. Additionally, the Governor Mitch Daniels’ office said Wednesday that Banina fully disclosed the matter while it was pending in his application for appointment as judge over Miami County Superior Court 2, which he was appointed to as of Jan. 1. At the time of the incident he was judge of what is now Miami County Superior Court 1.

The admonition was issued on Jan. 20, 2009, as was Price’s public reprimand. It was issued by Randall T. Shepard, Chief Justice of Indiana, and states Price cooperated with the commission and has no prior misconduct.

Messages left at Price’s firm and home were not immediately returned Wednesday afternoon. Dolan declined to release the name of the party who initiated the process to have the incident reviewed by state officials.

EAST MONTGOMERY COUNTY- After three days of collecting evidence at the Splendora home where Jose Israel Garcia-Ticas is charged with administering a fatal beating to his wife Sabrina Silva, Montgomery County Sheriff’s Office Major Crimes Detectives and Crime Scene Investigators finished the tedious task on Wednesday.
The single-wide mobile home in the 14500 block of Three S, a dead-end street, looks as though it has been empty for some time. Less than a week ago, a family of five lived there. Now the wife is dead, the husband is in jail and their three small children are with strangers. Garcia-Ticas told investigators a simple argument led to the beating that killed Silva, who was already deceased when they and their children arrived at Lyndon B. Johnson General Hospital in Houston in the early morning hours of Monday, according to MCSO Lt. Bill Bucks.
“She had signs of a beating, literally, from head to toe,” Bucks said. “Some of the bruising was in different stages of healing; some of it was very fresh; she had head trauma,” Bucks said.
Investigators have learned the couple had an “on-again off-again” relationship, and only recently reconciled. They moved from Houston to the Splendora residence with their children, all age six and under, just eight days prior to Silva’s death.
“It appears that the kids were in the house at the time of the beating, but the extent of what they saw or heard is not known yet,” he said. “The children are still being interviewed.”

Bucks said the children showed no signs of physical abuse.
Garcia-Ticas allowed LBJ staff to remove Silva from the pickup, took the children to a family member’s house, and immediately returned to the hospital.
Child Protective Services placed the children, two girls and a boy, in foster care and will determine where they go from there.
Since early Monday, investigators have removed, bagged, and documented pieces of the crime scene. Bucks said there were unusual factors that made the process a lengthy one.
“Based on the amount of blood and evidence that’s in the house, and the location – it’s not all confined to one room - it’s taken three days of solid evidence collection,” Bucks said.
The next step will also be time consuming.
“Just to process it initially and get it sent off to the state for evaluation will take weeks,” Bucks said. “The (evidence) we send off will take months to come back.”
Silva’s autopsy was performed at the Harris County Medical Examiner’s Office on Tuesday, the same day the Montgomery County Jail roster showed Garcia-Ticas’ bond was set at $400,000.

Members of the House Judiciary Committee,

I respectfully request the passage of HB2314 Protective Parent Reform Act. This bill is needed to protect citizens and their families from falsification of  documents, the illegal removal of their children and violations of due process and the completely immune ‘friends of the court’ e.g. Guardian ad Litems, Mental Health Professionals, and other 3rd party FOC’s who by their ‘opinion’ only (a severely uneducated opine) have destroyed countless lives.

I am a survivor of what this ‘law’ could have prevented. Now, fifteen years (and continues) my daughter and I. Sadly, the passage of this law now- will not help my daughter and I, those years are forever lost. However, it will help hundreds of other children (as well my daughters children) who are at this time beginning the same process that ‘forever’ stole her childhood.

As Dombrowski et al v. United States (2007) A petition filed on behalf of 10 protective mothers, one victimized child now grown to adult, and six organizations at the Inter-American Commission on Human Rights against the United States for the pattern and practice of courts granting custody and unsupervised visitation to abusers and molesters.

As a battered mother who survived, as an advocate and for the ‘hope’ of humanity- our  very future to which are-‘our children.’

I implore you to pass this into law without any pause.

I am available at  your convenience to provide further information, education, insight and or testimony to enact this law.

As a tax paying citizen, I request the passage of HB2314. The problems here in this state have been ignored long enough. This bill is needed to protect citizens and their families from falsification of  documents,the illegal removal of their children and violations of due process.

On December 19th, 2008, at the Joint Children's Issues Committee hearing in Topeka, SRS Don Jordan stated that they “make mistakes”, that we have laws that are different from the Regs, different from the policies and procedures and then we have law enforcement, which also has different polices and procedures. In other words they aren't following Federal and State laws. It's time for the Laws of Kansas to be followed and enforced. 

Enact a law that protects families.  Enact this law.

The legislators focused on an anonymous survey of SRS employees, in which allegations were made that employees were told to disregard federal and state laws.

(And some noted they had been approached by SRS employees who feared if they went public with problems at the agency they would lose their jobs. (This sounds familiar) – (how about a recent interview by KSN of a social worker that said she wouldn’t have a job if she didn’t do what the DA’s office told her)

We can go clear back to 2000 when Janet Schlansky was in charge.

When Schalansky was Secretary of SRS in March 2000 the SRS was audited.
Scalansky's comments: "We have failed these kids", "thousands of Kansas children have been taken from their homes and communities and inappropriately placed in state custody and foster care over the years..."
AND "SRS Admits Too Many Children Taken From Families"

(They are still taking too many children from families and INAPPROPRIATELY placing them in state custody - nothing has changed - just more children than ever)
