Katan, 26, was taken into custody on February 17, 2010 after Montgomery police officers responded to the man's home where the baby was reportedly unresponsive.

The man said he found his son wedged between the mattress of the bed and the bumper guard.

An autopsy showed the child, 2-year-old Preston Katan, died of multiple blunt force injuries to the head.

The man's ex father-in-law, Ed Chermak, told WSFA 12 News after the child's death that his daughter, "was afraid of him [Katan]." Chermak also said Katan threatened to kill himself if she didn't allow him to see his children.
